
The Australian and New Zealand trade mark offices (IP Australia and IPONZ) are a step closer to harmonising trans-Tasman mark examination practices.
From 1 February 2010, the offices will be trialling a mutual recognition program for trade mark examinations.
Applicants who have had their marks examined in one jurisdiction can have their examination outcome recognised when they apply for the same mark in the other jurisdiction.
The trial is the latest stage in a project that commenced in May 2006. The purpose of the project is to assess the potential for trans-Tasman trade mark examination practices to be harmonised.
The mutual recognition trial is being applied on an opt in basis. Applicants will have to specify in their (subsequent) application if they wish to be part of the trial.
